What are the consequences of disclosing personal data?

● the Labour Code,
● the Data Protection Act of 10. May 2018,
● the Civil Code.
The mere storage of personal files in inappropriate conditions, i.e. threatening damage, destruction or loss, is threatened with a fine of up to PLN 30,000 (article 281 point 7 of the Labour Code).
In turn, disclosing personal data to unauthorised persons is punished with imprisonment of up to 2 years (article 51 § 1 of the Act on personal data protection).
On the other hand, the Civil Code states that the employer will have to pay compensation to the employee for providing access to personal data. It is enough to prove that releasing the files caused negative consequences and infringed the injured party's interest (article 415 of the Civil Code).
As you can see, it's not worth risking paying out high damages or criminal liability. A personnel file cabinet will solve your problems and ensure that you don't have to worry about confidential employee data.
